Doctrinaire Trends In Terms Of International Legal Subjectivity Of The Individual
In the last few years part of the Doctrine gives a central role to the individual in the field of International Law. In this regard, the Doctrine reasons in terms of “humanization” of International Law especially for two reasons: a. due to the growing trend towards the protection of fundamental rights and freedoms; b. due to the existence of rules of International Criminal Law and their influence on the evolution of International Law. For these reasons, the Doctrine is discussing about an “evolution” of International Law from a Law of (and for the) States to a Law of (and for) individuals. In other words, the prerequisite of the asserted international subjectivity of individuals would be the existence of rights of the individuals directly detectable by international judicial system and susceptible of protection before international jurisdictions. As well as the existence of (“original”) international criminal rules from which the imputability of the individual as such at the international level would derive. The paper aims at highlighting the lack of foundation of the theory of the individual subjectivity and the pre-eminent role – indeed, the exclusive role – of the States in terms of subjectivity of International Law.
