The Florentine Juvenile Court in a decision of 7 March 2017, has recognized for the first time in Italy, the adoption of two minors by a couple of Italian citizens, who were unmarried and same-sex, pronounced in the foreign State in which they were established.This where adoptions that could not have been pronounced, in accordance with current Italian legislation, but as they were based on the UK law, and as were stemming from the Family Court (the UK competent authority), they had to be recognized through Article 36, paragraph 4, of the ‘new text’ of the Law n. 183 of 1984.Considering the entry in to force of the Law of May 20, 2016, n. 76 on Civil unions, the Family Court rulings cannot be considered in conflict with the public order, and above all, once emotional ties have been established inside the adoptive family, their recognition must be considered as corresponding to the best interests of the child.
