This work aims at examining the relationship between fundamental rights and the proper functioning of the internal market, particularly whenever these values of the European Union law enter into a conflict. The study is conducted with reference to the recent judgment of the Court of Justice of the European Union in the Manni case. Finally, it inquires on the question whether such a conflict is possible in EU law and the manner in which eventual conflicts between these values must be solved.
