This contribution aims at analysing and ascertaining the potential impact of the recently adopted Council Regulation 2017/9941 implementing enhanced cooperation on the establishment of the European Public Prosecutor’s Office (“the eppo”). This legislative act of the Union presents a long history of negotiation and both doctrinal and legal discussion among member States and eu institutions. Only after the entry in force of the Treaty of Lisbon (art. 86 tfeu) the idea to create a European Public Prosecutor’s Office had a clear legal ground. This article deepens the functioning and the structure of eppo and highlights how the long negotiation among member States and eu institutions led to a compromise with many procedural limits and unsolved legal problems.
