This book deals with the problem of “trial by media”. It explores the tension between the freedom of the press and the fundamental rights of trial participants from a comparative perspective. In particular, it discusses the European and American approach to court–related speech regulation, providing an overview of the different techniques used to solve the conflicts among free press, fair trial and human dignity. The book shows that it is the task of the law to prevent a socially valuable activity, such as informing the public about the workings of the justice process, from being transformed by market pressures into a power without responsibility.
